Terms and Conditions
These are the terms and conditions on which Wild Swim Scotland (“we” and “us”) provide swimming sessions to you, the customer (“you”). Please read them carefully before making a booking with us.
Your attention is particularly drawn to clause 19 – Disclaimer.
- Information about us and how to contact us. We are Wild Swim Scotland , based in Edinburgh. If you need to contact us, all the relevant contact details can be found on our website at Contact – Wild Swim Scotland. If we need to contact you we will do so using the information you provided us with when registering for sessions or with us on our website.
- These Terms and conditions apply to sessions we offer to adults: Private Lessons – 1:1 or 2:1 or small group private coaching. Group Sessions – group coaching sessions, where you purchase a place or a block of places. Memberships – taken out for a set period of time with a specific voucher allocation.
TERMS WHICH APPLY TO PRIVATE LESSONS, GROUP LESSONS AND MEMBERSHIP BOOKINGS
Booking and Pre-Course Swim Form
All participants are required to complete a Pre-Course Swim Form. We will ask you to complete a Google Form annually. Providing your name together with details of any medical condition you may have as well as your contact details which will include your telephone number, email address and postal address. You must tell us as soon as you can if any of these details change. Please note that we will use the information you provide us only in accordance with our privacy policy.
Bookings can be made online via the appointments page for the selected type or session or given event. The booking will not be guaranteed until you have paid in full and received a confirmation via email or messenger, at which point a legally binding contract will exist between “you” and “us”.
If we are unable to accept your booking for Private Lessons, we will let you know as soon as possible and will refund any amounts you have paid to us. We reserve the right to not accept your booking for any reason and need not tell you why.
Payment
Will be required via appointments page using the Stripe function or within 14 days if invoiced directly. If you think the amount we have charged you is incorrect, let us know as soon as possible. We will investigate the matter and, if you have paid too much, refund you the extra amount you paid. The price we charge for lessons will be as set out on our website, at the time you make your booking.
Cancellation
Cancellations made by Wild Swim Scotland due to weather or other “Force Majeure” will ensure a full refund to the participant or an alternative date given to suit both parties. Cancellation by the participant before 48 hours will result in a refund or an alternative date. Cancellation by the participant between 24 and 48 hours of the session will only allow an alternative date to be arranged. Cancellation after 24 hours or a “no show” will result in no refund being given to the participant.
Medical Conditions
When completing the Pre-Course Swim Form you must provide us with details of any medical condition(s) affecting you. Any medical condition which may result in the session being tailored to suit your needs, should be highlighted prior to the start of the session with the coach.
Amendments to sessions
Any amendments to sessions, for example, time, place etc will be communicated via email, What’s App messenger or text, in as timely a manner as possible.
Illness
Participants should not attend sessions if they are feeling unwell. We reserve the right to prevent you from taking part in the session if we reasonably believe that you are not in a fit state to participate.
Disclaimer
Open Water Swimming is physically challenging at carries with it risks that we cannot entirely eliminate. A full Risk Assessment has be completed on each venue used to minimise the impact of the associated risks. This will be reviewed and any additional risk factors will be recorded on a session by session basis.
Participants must make themselves aware of the inherent risks and act accordingly, they should take advise given on required and recommended kit and follow the guidelines below;
You must act responsibly and sensibly at all times;
You must not participate if you are pregnant or under the influence of alcohol or non-prescription drugs;
You must follow any safety warnings or instructions displayed or given to you by the coach.
We are not qualified to express an opinion that you are fit to safely participate and you must obtain professional or specialist advice from your doctor before doing so.
Refunds
Any refund due to you as set out in these terms and conditions will be refunded to you by the method you used for payment and within 14 days us agreeing that a refund is due.
Participants with disabilities and special needs
We do all we can to accommodate participants with disabilities and special needs. If you have a disability or special needs, we will work with you to establish how best we can accommodate you and will make recommendations on the level and type of teaching based on our professional judgement.
